Understanding and Using the Landscape Ontario Standard Form Winter Maintenance Service Contract
A bad winter maintenance contract can have extremely significant consequences to your business. A good contract will help you manage the risk of a slip and fall and help you get paid. The LO Standard Form Contract manages and assigns risk between you and your clients in a fair and reasonable way. However, it is important that you understand how the contract works. In this seminar, Kennaley Construction Law, the drafters of the contract at first instance many years ago, will review the terms and help you understand both how it works and how you might incorporate it into your business.
 
Rob Kennaley, Kennaley Construction LawRobert Kennaley worked in the construction industry for 15 years before going to law school. He has practiced exclusively in the area of construction law since graduating from law school 22 years ago and is currently the principal of Kennaley Construction Law. Rob's day to day practice involves contract drafting and review, dispute resolution and negotiations, construction lien and trust claims, claims involving owners, consultants and insurers, tendering issues and claims, building code violations, claims against performance and labour and material payment bonds and Occupational Health and Safety Act issues. The Winter Maintenance Contractor, The Insurer, The Additional Insured, and Obligations of Defence and Indemnity
Winter maintenance contractors often sign contracts requiring them to add landlords to their insurance policies as “additional insureds”. What happens when there is a slip and fall and someone is hurt? Our courts have recently handed down important decisions that have interpreted the rights of the additional insured listed in an insurance policy, and the obligations as between winter maintenance contractor and landlord. These cases have impacted how slip and fall cases are handled in this Ontario. This presentation will explain how the court’s decisions will affect you.
 
Ian Mair, BA, LLB, Moodie Mair Walker LLPIan Mair is a lawyer. Ian practices exclusively in the area of civil litigation. His firm, Moodie Mair Walker LLP, is based in Toronto, but the firm handles cases all across Ontario. Ian is frequently retained by insurance companies to defend complex personal injury cases; and, since 1988, when he was called to the Ontario Bar, he has handled thousands of these cases. Ian is an accomplished advocate, who has tried many cases to verdict, before juries, and judges alone. He is often hired by other lawyers to appear in court as their trial counsel. Ian is a member of the Advocates Society, the Ontario Bar Association, Canadian Defence Lawyers, and the DRI – Defence Research Institute. He has been chosen by his peers to be listed in Best Lawyers in Canada in the area of Insurance Law.

Cst. Vito Pedano #2105, Peel Region Police 
Constable Vito Pedano is a 20-year veteran of the Peel Regional Police Service where he has served on a number of different units including Uniform Patrol, Criminal Investigations Bureau, Neighbourhood Policing Unit, Homicide, and a 13-year term in Road Safety Services. During this lengthy tenure with the Road Safety Services unit, Cst. Pedano obtained his designation as a CVSA Truck Inspector. He joined the Crime Prevention Services unit in 2018 to support its Community Engagement and Inclusion mandate, providing education and support to the community on a number of subjects including Media Distraction, Cyber Academy, Crime Prevention Academy, Drug Education, Identifying Vulnerabilities in Youth, fraud and internet safety, personal safety and social media. Cst. Pedano is CPTED (Crime Prevention Through Environmental Design) certified, conducting audits at various businesses, schools and residence locations. His wealth of knowledge in all facets of policing, along with an approachable and welcoming personality, enable him to succeed in protecting the safety of Peel Region and its residents.

The winter of 2018-2019 may prove especially challenging for contractors in the snow and ice removal business. A recent strike at a salt mine, coupled with contractual obligations to municipalities means the supply of salt may be drastically reduced, and prices will be higher. Landscape Ontario's Snow and Ice Management Sector Group have been working on the issue and met in late August with key players and advisers to discuss operational strategies as well as the risk factors and legal implications to contractors.
